Rental Terms and Conditions

1. 續租：
   所有租約均參與自動續約，我們會在您租約到期前兩週透過電子郵件通知續租。如果您希望取消續約，請登入您的帳戶，取消下一期租約，並於租約到期後七天內歸還樂器和相關配件。樂器歸還請參考第三點。

2. 樂器更換：
   您可以隨時更換租借的樂器，可以更換成相同等級但不同尺寸的樂器，不需支付任何費用。若您需要升級至更高階的樂器，只需支付剩餘租約差額，並進行升等合約續租程序。更換樂器時，請將樂器和相關配件全數歸還。

3. 歸還與退款：
   租約到期後，如果不進行續約，請在租約到期後七天內將樂器和相關配件全數歸還。若逾期未歸還樂器，每月將被評估10元的滯納費。我們保留向已登錄的信用卡收取兩個月的續租費用的權利，並持續收取續約費用，直到樂器和相關配件歸還為止。若您未能按時付款或未事先通知我們搬遷，我們保留向已登錄的信用卡收取樂器購買價格的權利。若您未歸還樂器，我們有權採取所有法律救濟措施追討您所欠的款項或因未歸還樂器而對您提起訴訟等。在這種情況下，您可能需要支付逾期租金費用、滯納費用、法律費用、法院費用、收集費用以及樂器的價值。樂器在租借合約期間內無法退款。

4. 責任損害豁免：
   在樂器租賃合約期間，您須對樂器的損失或損壞負責。您可以透過我們提供的責任損害豁免承擔部分責任。責任損害豁免涵蓋常規維護、Deer Musik確認的意外損壞及盜竊（若樂器於安全環境中被盜並於盜竊發生後30天內提交警方報告）。您必須及時支付所有租金及其他應付款項，方可申請責任損害豁免。責任損害豁免不涵蓋未經Deer Musik事先同意的空運或海外旅行，也不涵蓋從車輛或其他不安全的地方盜竊的樂器、琴漆因受熱損壞或由天氣或其他環境因素引起的損壞。此外，責任損害豁免不涵蓋您或任何其他人故意造成的損壞（包括刮痕）、未經授權的維修所導致的損壞、運輸中的損壞或任何運輸費用的補償。如您收到樂器時發現有損壞，請於收到樂器後24小時內通知我們；逾期發現的損壞將視為在您租賃期間內發生。若一件樂器超出了合理修復範圍，您必須支付損壞費用（標準大提琴：$450，進階大提琴：$900）。損壞費用需於報告或發現損壞時支付，未付款將導致已登陸之信用卡被收取費用。

5. Rent-to-Own點數回饋計畫：
   每次租約，您將獲得賃費用的20％，可用於購買Deer Musik的樂器和周邊配件。租賃費用不包括稅款或其他退款的租金。Rent-to-Own回饋點數將在您的租賃帳戶關閉日期兩年後到期。點數不可轉讓給其他人。

6. 樂器存放地點：
   除非經我們書面同意，否則您不得將樂器從本協議所示地址移動。在本協議有效期內，您不得出售、典當、處置或抵押該樂器作為擔保。除非您已收到我們的退還收據，否則您應對所有付款和樂器價值負責。

1. Lease renewal:
   All leases are subject to automatic renewal. We will notify you via email two weeks before the lease expires to renew. If you wish to cancel the lease renewal, please log into your account, cancel the next lease term, and return the instrument and related accessories within seven days after the lease expires. Please refer to point 3 for instrument returns.

2. Instrument replacement:
   You can replace the rented instrument at any time. You can replace it with an instrument of the same level but a different size without any charge. If you need to upgrade to a higher-level instrument, you only need to pay the remaining lease difference and go through the upgrade contract renewal process. When replacing the instrument, please return all the instrument and related accessories.

3. Returns and Refunds:
   After the lease expires, please return all instruments and related accessories within seven days. If the instrument is not returned on time, a late fee of $10 will be assessed each month. We reserve the right to charge the two months’ renewal fee to the registered credit card and continue to charge the renewal fee until the instrument and related accessories are returned. If you fail to pay on time or fail to notify us of your move in advance, we reserve the right to charge the instrument purchase price to the registered credit card. If you fail to return the instrument, we have the right to take all legal remedies to recover the amount owed or to sue you for failure to return the instrument, etc. In this case, you may be required to pay overdue rent, late fees, legal fees, court fees, collection fees, and the value of the instrument. The instrument cannot be refunded during the rental period.

4. Liability Damage Waiver:
   During the instrument rental agreement, you are responsible for any loss or damage to the instrument. You can assume partial responsibility through the liability damage waiver we provide. The liability damage waiver covers routine maintenance, accidental damage confirmed by Deer Musik, and theft (if the instrument is stolen in a secure environment and a police report is submitted within 30 days of the theft). You must pay all rent and other payments due in a timely manner before applying for a liability damage waiver. The liability damage waiver do not cover air or overseas travel without prior agreement from Deer Musik, instruments stolen from vehicles or other unsafe places, damage caused by heat or environmental factors, and intentional damage (including scratches) caused by you or any other person, damage caused by unauthorized repairs, damage during transportation or any compensation for transportation costs. If you discover any damage to the instrument upon receipt, please notify us within 24 hours of receipt; damages discovered after the deadline will be considered to have occurred during your rental period. If an instrument is damaged beyond reasonable repair, you must pay for the damage (standard cello: $450, advanced cello: $900). Payment for damage must be made at the time of reporting or discovery, and failure to pay will result in charges being made to the registered credit card.

5. Rent-to-Own Rewards Program:
   With each rental agreement, you will receive 20% of the rental fee as points that can be used to purchase instruments and accessories from Deer Musik. The rental fee does not include taxes or rental fees for any refunds. Rent-to-Own rewards points will expire two years after the closing date of your rental account. Points cannot be transferred to other individuals.

6. Location of Instrument Storage:
   Unless we have provided written consent, you may not move the instrument from the address specified in this agreement. During the term of this agreement, you may not sell, pawn, dispose of, or use the instrument as collateral. You are responsible for all payments and the value of the instrument until you have received a return receipt from us.
